Trusts people – this is your year!
Post the Trusts Act 2019 coming into force in 2021 and with the cases coming through under that legislation, we know it’s time to support those working in the complex world of trusts law with authoritative commentary from people working in the field.
Thomson Reuters are fortunate to have attracted authors from those working in trusts law, those lecturing in trusts law, those chosen to be on the Law Commission’s expert panel when the new trusts legislation was being considered and those speaking to the legislation in conferences around the country.
This year, we have programmed for release:
- the reviewed and rewritten Working with Trusts (New Zealand Guide to Trusts) online and looseleaf product:
- the release of the latest Andrew Butler (ed) Equity & Trusts in New Zealand (3rd edition):
- the release of Nicola Peart’s Trusts Act 2019: Act and Analysis.
First off the rank will be the release of the Working with Trusts (New Zealand Guide to Trusts) online and looseleaf update in April. Chapters 1 to 5 have been reviewed by Colette Mackenzie, Director at Greg Kelly Law Limited, who has rewritten the chapters (now eight of them), ready to be included in the April update. Greg Kelly Law is a firm that specialises in trust law and Colette advises on all aspects of the discipline, particularly the interrelationship between trusts and relationship property. She presents papers at NZLS conferences and leads forums for NZLS CLE on trusts law, in particular on the Trusts Act 2019. She has also co-authored an authoritative text on the subject Garrow and Kelly: Law of Trusts and Trustees (8th ed, 2022). We are very excited to have someone of her calibre on board.
After this, the latest edition of Equity & Trusts in New Zealand (3rd edition) is expected to be out in July and we are very excited to announce that a much prayed for release of Professor Emerita Nicola Peart’s Trusts commentary on the Trusts Act 2019, as part of the Act and Analysis series, is programmed to happen this year. This commentary is lodged in the Family Property product, but its breadth of commentary and analysis is sought after by practitioners outside of the family trusts area as well. The release of this book will enable all practitioners to have access to this gold standard, reliable material, referred to by judges, with commentary and cited judgments under every section of the Trusts Act.
